Diversion Programs

The Choctaw Nation DUI Diversion Program is a restorative initiative designed to address the root causes of impaired driving. By offering financial assistance for treatment, education, and support services, the program empowers participants to make lasting changes and avoid future offenses.

What the Program Offers

Participants may receive financial assistance for services deemed necessary by Department of Criminal Justice. Services included are:

  • An Alcohol and Drug Assessment Course (ADSAC)
  • A DUI Course
  • A Victim Impact Panel
  • Outpatient Counseling
  • Breathalyzer or Ignition Interlock Device
  • A Sober Living Fund

Eligibility Requirements

To qualify for the DUI Diversion Program, applicants must meet the following criteria:

Charge Requirements

  • First-time misdemeanor DUI offense
  • No prior deferred sentences
  • Incident did not involve an injury
  • Not an aggravated DUI (BAC below 0.15)

Plea Requirements

  • Must plead guilty or no contest
  • Sentencing is deferred 6 months to allow time for program completion

Program Outcomes

Upon successful completion of the program, participants may be eligible for:

  • Case dismissal, or
  • An unsupervised deferred sentence
